Membership Agreement​

MTP (MTP) Club offers pickleball courts and table tennis for singles, doubles, and mixed doubles pickleball matches, tournaments, leagues, and events, and the Member wishes to participate in these offerings and to enjoy other amenities offered, including but not limited to restrooms, party rooms, sports bar, lounge, viewing areas, cafe, and pro shop, unless noted otherwise.
 
A. Membership Agreement

 

This Membership Agreement consists of sections A through F below as well as the MTP Club Membership Standard Terms and Conditions (the “MTP Standard Terms and Conditions”) found at morethanpball.com/memberships, collectively referred to herein as the “Membership Agreement” which governs your MTP Club membership under the membership plan that you select below.  This Membership Agreement is important and affects your legal rights, please read it carefully.  Throughout this Membership Agreement we will refer to you as “you” or “Member” and to More Than Pickleball LLC as “we” or “MTP Club.”   
 
Please Note: Section 7 of the MTP Standard Terms and Conditions contains a mandatory arbitration provision that requires the use of binding arbitration on an individual basis and limits the remedies available to you in the event of certain disputes.
 
B. Membership Plans

 

MTP Club offers several membership plans.  Each membership plan begins on the date of purchase, or if MTP Club is not open for business on the date of purchase, your start date will be the later of the date you purchase your membership plan, or the date MTP Club opens for business (the “Start Date”) and automatically renews in accordance with the terms of the Membership Agreement.  You are responsible for all applicable sales and other taxes associated with the purchase of your Membership Plan.  Memberships are only valid at the specific MTP Club location where you purchase the membership (the “Club”):
 
Month-to-Month Plan - $129 per member monthly: This Plan begins on the Start Date and continues for a period of thirty (30) days and will automatically renew and continue monthly until you expressly cancel your membership or MTP Club cancels your membership in accordance with the terms of this Membership Agreement.
 
C. MEMBER DETAILS

 

Membership Fees and applicable taxes and fees will be automatically charged to your Payment Method on the monthly anniversary Start Date of your respective Month-to-Month Plan.
 
D. MEMBER BENEFITS

 

As a member of MTP Club, you will have access to MTP Club facilities including pickleball courts, pro shop, café, lounge/viewing areas, restrooms, and lockers (additional fee may apply) at the Club where you purchase your membership.  In addition, you will enjoy the following Member Benefits:

 

• Open Pickleball Play

• Court Reservations (subject to availability and other restrictions)

• Access to MEMBER ONLY Tournaments, Leagues, and Events

• Access to on-court technology for livestreaming and recording of game play (subject to availability and other restrictions)

• Access to MEMBER ONLY stretching / workout area

• Discounted fees for public tournaments, leagues, and events.

 
E. HEALTH ATTESTATION

 

You attest that you are fully able to participate in pickleball activities and any other exercise of your choice without undue risk.
 
F. TERMS AND CONDITIONS

 

The MTP Standard Terms and Conditions are incorporated and are binding on you.  The MTP Standard Terms and Conditions are found at More Thanpickleballclub.com/memberships.
 

1. RIGHT TO CANCEL OR TERMINATE

 

Without limiting Section 5 of the MTP Club Standard Terms and Conditions:
 
(i) Month-to-Month Plan Membership: you may cancel your Month-to-Month Plan membership within forty-eight (48) hours after the Start Date using the online cancellation/termination method described below, and you will receive a refund of pre-paid fees, minus $25.00.  You agree that the initial term of your Plan will start on the Start Date. You agree that, on the date of each automatic renewal, the then-current membership price, plus any then-applicable taxes, fees, and charges, will be charged to your payment method on file.  You understand that, if you do not want your Month-to-Month membership to be renewed, you must cancel/terminate it at least thirty (30) days before the next automatic renewal date. You understand that you may cancel or terminate your Month-to-Month Plan membership for any reason by emailing MTP Club at info@MoreThanPball.com.
 
(ii) MTP Club reserves the right to cancel, suspend, or revoke a membership or deny Club admission to any Member at any time for any reason.  Cancellation/Termination, suspension, or revocation of Club privileges under a membership Plan due to your violation of MTP Club policies or rules, may, at MTP Club’s sole discretion, result in you being barred from visiting any other MTP Club without any refund or prepaid fees.
 
2. PRIVACY

 

MTP Club’s Privacy Policy can be found at https://www.More Thanpball.com/terms-and-conditions which includes information about how we collect, use and disclose information about you as part of your membership Plan. By enrolling in a membership Plan, you acknowledge that you have read MTP Club’s Privacy Policy.  As a Member you agree to the terms of the MTP CLUB Privacy Policy and the use of your personal information as set forth therein.   
        
3.  WAITING LIST

 

If you cancel or terminate your membership, you may take the last position available on the Waiting List for memberships at that Club. The membership position vacated by you will be offered to those on the Waiting List in order of priority based on when they joined the Waiting List.
 
4.  ASSUMPTION OF RISK AND POTENTIAL LIABILITY

 

In accordance with and without limiting sections 8 of the MTP Club Standard Terms and Conditions, you must sign a MTP Liability Waiver Form before entering any MTP CLUB.  Further, you acknowledge and agree that there are risks involved with any fitness, sports, and physical activity, the use of courts and pickleball equipment, and participation in an activity, program, event, or sport such as pickleball and table tennis, and such risks may include the risk of serious bodily injury or death.  You knowingly and voluntarily assume all risks of liability, loss, illness, death, or injury caused or arising out of the use of pickleball courts, equipment, other attractions, services, facilities, or your participation in any activities at an MTP Club.
 
5.  DAMAGES

 

You agree and shall pay for any damages to the equipment or premises of the MTP Club, resulting from you or your guest’s improper use, violation of rules, or misconduct.
 
6.  MTP CLUB RULES AND RESPONSIBILITIES

You shall abide by all the safety guidelines, rules, instructions, signage, and regulations set by MTP Club while using the facilities or equipment or the service. You agree that you and your guests shall always abide by MTP’s dress code while in an MTP Club. Consumption of drugs, alcohol, tobacco, or similar addictive substances are strictly prohibited at MTP. Violence of any kind is not permitted in any form and will result in suspension or termination of membership.

 

You are required to update your membership status on an annual basis. You must respect each member, staff and guest at MTP Club in all circumstances and take care of the courts and equipment after every use. 
You must clear the pickleball and table tennis playing area of any obstructions, obstacles, or safety hazards both prior to and after play.

 

No person shall be allowed in the pickleball and table tennis playing areas unless they have signed the MTP Club Participation Agreement and Waiver. You must abide by the Rules of Play as posted throughout MTP, which may be updated from time to time. 
 
7. ARBITRATION

 

IN ACCORD AND WITHOUT LIMITING SECTION 20 OF THE MTP CLUB STANDARD TERMS AND CONDITIONS, EXCEPT FOR ANY DISPUTES, CLAIMS, SUITS, ACTIONS, CAUSES OF ACTION, DEMANDS OR PROCEEDINGS (COLLECTIVELY, “DISPUTES”) IN WHICH EITHER PARTY SEEKS TO BRING AN INDIVIDUAL ACTION IN SMALL CLAIMS COURT, YOU AND MTP AGREE (A) TO WAIVE YOUR AND MTP CLUB’S RESPECTIVE RIGHTS TO HAVE ANY AND ALL DISPUTES ARISING FROM OR RELATED TO THIS AGREEMENT AND THE PLAN, RESOLVED IN A COURT, AND (B) TO WAIVE YOUR AND MTP CLUB’S RESPECTIVE RIGHTS TO A JURY TRIAL. INSTEAD, YOU AND MTP AGREE TO ARBITRATE DISPUTES THROUGH BINDING ARBITRATION (WHICH IS THE REFERRAL OF A DISPUTE TO ONE OR MORE PERSONS CHARGED WITH REVIEWING THE DISPUTE AND MAKING A FINAL AND BINDING DETERMINATION TO RESOLVE IT INSTEAD OF HAVING THE DISPUTE DECIDED BY A JUDGE OR JURY IN COURT). YOU AND MTP CLUB AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATED TO THIS AGREEMENT AND THE PLAN IS PERSONAL TO YOU AND MTP CLUB AND THAT SUCH DISPUTE WILL BE RESOLVED SOLELY THROUGH INDIVIDUAL ARBITRATION AND WILL NOT BE BROUGHT AS A CLASS ARBITRATION, CLASS ACTION, OR ANY OTHER TYPE OF REPRESENTATIVE PROCEEDING.
 
8. MISCELLANEOUS

 

By signing this Membership Agreement, you represent, or acknowledge and agree (as the case may be), that:

 

You have authority to bind each of the members listed above to the terms and provisions of this Membership Agreement;

 

You will promptly notify MTP Club of any changes in your account or membership information;
 
You are an authorized user of and have authority to use the credit card or other payment method used to purchase the membership, and you will not dispute the scheduled transactions with your bank or credit card company so long as the amounts charged are in accordance with the provisions of this Membership Agreement;
 
You understand that MTP Club will not charge you a fee for authorizing recurring payments, but that your financial institution may charge you a fee for accepting and processing electronic transactions.
